Child Custody in Virginia

  • Physical custody: Physical custody refers to the physical amount of time spent with the child/children. Parents with joint physical custody will typically each have a significant amount of parenting time. However, one parent will generally be designated as the primary custodial parent (the parent with which the child resides).
  • Legal custody: In most cases, it is in the child's best interest for parents to have joint legal custody - meaning both parents take part in major decisions involving the child, such as religious upbringing, schooling, health care, etc.
  • Visitation rights: In most cases, it is in the child's best interest to have a meaningful relationship with both parents. Therefore, the non-custodial parent (joint or sole custody) is usually granted parenting time according to a visitation schedule. This parent also pays child support according to Virginia's child support guidelines.
  • Modifications: It is unrealistic to expect that a child custody arrangement established at the time of divorce will still address the current needs of the family several years later. Therefore, when there is a significant change in circumstances, the court will revisit the child custody agreement to ensure it reflects current situations.
